The privacy issue comes after Australian law changes introduced in 2017 to require the government to get court approval for online tracking.
This means ads can now only be displayed in Australia if a court has made a finding that they are likely to cause a person serious harm.
Privacy Commissioner Peter Dutton says a number of states and territories have implemented the law.
“The Australian Government is not obliged to go through the process of making that finding,” he said.
“It is a requirement of law, and the Government is required to seek approval from a court.”
Privacy Commissioner Dutton said a number countries and territories were taking the lead in enforcing the law around online advertising.
“This is something we are working to see countries like Canada, Canada, New Zealand and some other countries implement the law, but the Government will not necessarily follow suit in those cases,” he told ABC News Breakfast.
“If you are in a jurisdiction that is doing it, you have the option of having your ad displayed there.”
